Terms and Conditions for the AktivPass and ARENA365 MemberCard

(1)     The AktivPass is an additional service product to the existing guest card of the Tiroler Zugspitz Arena (“TZA” – Tourismusverband Tiroler Zugspitz Arena), AT 6632 Ehrwald, Schmiede 15 (info@zugspitzarena.com | www.zugspitzarena.com).

(2)     These Terms of Use govern the use of the TZA’s AktivPass by guests of participating lodging establishments, as well as—where applicable—by local residents and other authorized user groups.

(3)     “AktivPass” is the service product offered by TZA that allows authorized users to access certain services provided by participating regional providers in accordance with these Terms of Use.

(4)     “Eligible Users” are individuals whose guest card or other card approved by TZA for the AktivPass has been activated in the system.

(5)     “Service Providers” are the operators of recreational, sports, adventure, or other tourist facilities participating in the AktivPass program.

(6)     For guests of participating lodging establishments, the AktivPass is activated via the guest card. A key requirement is that the respective lodging establishment participates in the AktivPass program.

(7)     The TZA may also make the AktivPass or a limited-use AktivPass card available to local residents and other user groups. Special prices, advance purchase periods, validity periods, scope of services, and proof requirements may apply to these user groups.

(8)     Entitlement to the issuance, activation, extension, or renewal of an AktivPass exists only in accordance with the product and participation requirements established by the TZA.

(9)     The AktivPass is valid only for the validity period stored in the system and requires activation of the AktivPass by the system.

(10)     For guests of participating lodging establishments, eligibility for use is based on the registered length of stay (including the arrival and departure dates).

(11)     Use outside the activated period is not permitted. Unused services will neither be refunded nor redeemed for cash.

(12)     The AktivPass entitles the holder to use those services that are published by the TZA as AktivPass services.

(13)     The following facilities or services are currently included (as of the 2026/2027 season) (food and beverage services are not included):

• Bärenarena Berwang (forest swimming pool, mini-golf, and tennis) operated by Bärenarena Freizeitanlagen GmbH;
• Panorama Outdoor Pool Lermoos operated by Winter- und Sommersportprojektierungsgesellschaft m.b.H.;
• Freizeitbetriebe Tiroler Zugspitze in Ehrwald (Ehrwald Climbing Hall, Ehrwald Indoor Tennis Hall, Ehrwald Artificial Ice Rink) operated by Freizeitbetriebe Tiroler Zugspitze GmbH & Co. KG;
• TZA 3D Archery Course in Ehrwald.

(14)     Mountain railways and public transportation are not included in the AktivPass unless they are expressly designated by TZA as AktivPass services.

(15)     The specific scope of services may vary depending on the user group, season, operating hours, capacity, weather conditions, official regulations, safety conditions, and technical availability.

(16)     The TZA may designate services as included benefits, discounted services, or other benefits. If services are offered only at a discount, the user is responsible for paying the remaining balance.

 (17)     To access AktivPass services, the user must present a valid and activated AktivPass (integrated into the respective guest card for guests) to the service provider and have it scanned.

(18)     Upon request, the user must present an official photo ID or other suitable proof of identity.

(19)     The user is required to verify, prior to use, whether the respective service is available on the day in question and whether there are any special requirements, reservations, age restrictions, safety instructions, or equipment requirements.

(20)     Service providers are entitled to refuse access if the card is invalid or not activated, if the scan fails, if identity or authorization cannot be verified, if capacity limits have been reached, or if safety, operational, or regulatory reasons preclude access.

(21)     The AktivPass is personal and non-transferable. Transferring, lending, selling, or allowing multiple uses by unauthorized persons is prohibited.

(22)     Any misuse, in particular use by third parties, tampering with the card or digital authorization, or circumventing the scanning system, is prohibited.

(23)     In the event of misuse or a well-founded suspicion of misuse, the TZA and/or the service provider may refuse use, block the card, confiscate it, or deactivate its authorization.

(24)     The TZA and/or the service provider reserve the right to assert further claims, in particular for compensation for any damages incurred.

(25)     Use is only permitted during the respective opening, operating, and seasonal hours of the relevant service provider.

(26)     TZA does not guarantee that all services will be available at all times, on a daily basis, without wait times, or to a specific extent.

(27)     Services may be restricted, interrupted, or suspended, in particular due to weather conditions, inspections, maintenance, renovations, events, overcrowding, staff shortages, technical malfunctions, force majeure, regulatory requirements, or safety reasons.

(28)     Temporary restrictions on individual services do not give rise to any claim for a refund, price reduction, substitute service, extension, or damages. However, in the event of a long-term or permanent interruption of an essential, value-determining service, only users who have paid a fee directly to TZA (e.g., local residents) are entitled to reasonable compensation. Guests whose AktivPass is an included service provided by their lodging establishment are not entitled to this compensation. The nature and amount of the compensation depend on the duration and extent of the disruption, as well as the affected user group.

(29)     In addition to these Terms of Use, the respective house rules, swimming rules, climbing rules, play rules, safety rules, and usage regulations of the participating service providers—as posted or published—apply. Mandatory safety, operational, or regulatory requirements of the service providers take precedence.

(30)     Service providers may make use of certain facilities subject to specific requirements, including, but not limited to, age, height, health status, swimming ability, climbing skills, safety instruction, appropriate equipment, or adult supervision.

(31)     Users must immediately comply with instructions from TZA staff and service providers.

(32)     In the event of violations of usage or safety rules, the user may be excluded from individual services or from the AktivPass program entirely.

(33)     For guests of participating lodging establishments, the AktivPass is processed through the participating lodging establishment.

(34)     An annual pass is available for local residents, which can be purchased at the prices set by the TZA.

(35)     Unused services may not be redeemed for cash, refunded, or transferred.

(36)     Loss, theft, damage, or technical problems must be reported immediately to the lodging provider or the TZA.

(37)     The TZA may provide a replacement card or technical restoration. There is no entitlement to a replacement if misuse, lack of identifiability, or technical reasons prevent it.

(38)     When using digital cards, the user is personally responsible for ensuring that their device is in working order, has sufficient battery charge, an internet connection, a wallet function, and that the card is legible.

(39)     The TZA organizes, coordinates, and promotes the AktivPass. However, the operational delivery of the individual services is carried out by the respective service providers under their own responsibility. The TZA handles the administration and sale of the AktivPass in its own name, but on behalf of the respective service provider.

(40)     The respective service provider is solely responsible for operations, safety, supervision, traffic safety, personnel, the condition of facilities, and the proper provision of services. The user enters into the service contract exclusively with that service provider.

(41)     TZA is liable only for damages caused unlawfully and through fault by TZA or persons for whom TZA is responsible. TZA’s liability for the service provision, operational management, or safety organization of the service providers is excluded, unless TZA itself is the service provider (e.g., archery course).

(42)     The use of sports, recreational, and tourism services must take into account the user’s personal abilities, state of health, and personal responsibility, and is the user’s sole responsibility. The user is personally responsible for assessing these conditions before and during use and for utilizing the services only within the limits of their individual capabilities.

(43)     TZA may adjust the design, scope of services, technical processes, participating service providers, prices, and other product parameters of the AktivPass to the extent that this is objectively justified.

(44)     Users who have already been activated will be informed of material changes in an appropriate manner (e.g., through the respective lodging facility), provided that and to the extent this is practically possible, appropriate, and necessary.

(45)     Changes due to security, operational, regulatory, technical, or force majeure reasons are permitted at any time.

(46)     Personal data is processed for the issuance, activation, monitoring, use, and billing of the AktivPass, including, in particular, identification data, residence data, card data, activation data, usage and scan logs, and billing data.

(47)     Data processing is carried out for the purpose of operating the AktivPass, verifying eligibility, monitoring for misuse, technical processing, billing, and fulfilling legal obligations.

(48)     Details regarding data processing, recipients, retention periods, and the rights of data subjects are set forth in the currently applicable privacy policy of TZA or the lodging establishments and service providers. This policy is available here.

(49)     Complaints regarding specific services should, whenever possible, be filed directly with the respective service provider.

(50)     Complaints regarding activation, technical processing, or general AktivPass matters should, whenever possible, be directed to the TZA.

(51)     When filing a complaint, the user must provide all reasonable information, including, in particular, their name, card number, lodging facility, date, the service in question, and a brief description of the facts.

(52)     TZA may temporarily or permanently suspend the AktivPass if the user violates these Terms of Use, if there is suspicion of misuse, if payment or participation requirements are not met, or if technical or legal reasons so require.

(53)     Service providers may refuse individual uses or expel users from the facility if this is necessary for safety, operational, capacity, order, or regulatory reasons.

(54)     A justified suspension or exclusion does not entitle the user to a refund or compensation.

(55)     Austrian substantive law applies, excluding the conflict-of-laws rules of private international law and the UN Convention on Contracts for the International Sale of Goods.

(56)     Unless mandatory rules regarding venue preclude it (e.g., consumer courts at the consumer’s place of residence), the court with subject-matter jurisdiction at TZA’s registered office in AT 6632 Ehrwald shall have jurisdiction over disputes arising from or in connection with the AktivPass.

(57)     Should any provision of these Terms of Use be or become invalid or unenforceable, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a valid provision that most closely approximates the economic purpose of the invalid provision.

(58)     TZA is entitled to amend these Terms of Use for objectively justified reasons (e.g., changes in the legal framework, case law, or market conditions), provided that the amendments are reasonable for the user. Users (or, in the case of guests, the respective lodging provider) will be notified in writing of planned amendments no later than four weeks before they take effect. Consent to the amendment is deemed to have been granted if the user does not object within a period of three weeks from receipt of the notice of amendment. The user will be specifically informed in the notice of the right to object and the legal consequences of remaining silent. In the event of an objection, TZA has the right to terminate the contractual relationship with notice.
